MENU FOODS PROCEES WITH CLAIM SETTLEMENT PROCESS

MAY 14, 2007

Since the recall began on March 16, 2007, Menu Foods has received hundreds of thousands of calls from concerned consumers. We have made every effort to respond in a timely and caring manner, although given the sheer volume of calls it has been impossible to do this to everyone's satisfaction. All of us at Menu Foods want to express sympathy to those people whose pets have been sick or have died, and want to reassure consumers that we are doing everything we can to address individual concerns.

Menu Foods desires to address any reasonable expense incurred by pet owners that we can identify as being caused by contamination of Menu Foods' products. Many pet owners are now wondering when they can expect to receive payment from Menu Foods for such expenses.

Some pet owners have chosen to file lawsuits (including alleged class actions), and they have every right to proceed as they and their lawyers see fit. However, Menu Foods also knows that there are many pet owners who are more interested in settling their claims directly with Menu Foods. Menu Foods is now prepared to begin settling claims directly with pet owners who wish to proceed in that fashion.

Crawfod & Company, a professional claims adjustment firm retained by Menu Foods' insurer, will soon be mailing a Claims Form and related information to all persons who have contacted the Menu Foods call center and indicated they wish to make a claim. The information contains a letter that describes the legal options available to pet owners and provides instructions on how to begin the settlement process directly with Menu Foods.

To assist those individuals who wish to get this process underway as soon as possible, a complete package of material for both United States and Canadian resident claimants has been posted on the Menu Foods website.

I would not trust Menu Foods with a pet ant, but here's my point.  Whatever they say, they're going to look at this just like companies look at people who have been poisoned by, say, asbestos or gotten some other kind of cancer from the environment--they make it virtually impossible to prove that your particular pet was killed by their food.  So, for what it's worth I'm in a class action suit and would recommend that Menu Foods is trying to take the heat off themselves and discourage suits by making this claim that they will pay for doctor bills.  They killed my dog Joe, and that's all I care about.
